Welcome to Aegitox ("we," "our," or "us"). We are proudly built to support and enhance the Discord ecosystem. By accessing or using our website, Discord AI moderation bot, API, and related infrastructure (collectively, the "Service"), you agree to enter into this Enterprise Terms of Service partnership. This document outlines our shared commitment to creating safer communities and defines our respective roles in achieving that goal.
1. Our Shared Ecosystem & B2B Partnership
Empowering Your Community (OAuth2 Authorization): By initiating the Discord OAuth2 authorization flow, you apply your electronic signature to this Master Service Agreement. You represent that you are the authorized leader and possess the legal authority to bind your respective Discord Guild or corporate entity to these terms. In our partnership, you are recognized as the "Guild Owner," the visionary shaping your community's culture.
A Unified Understanding (Integration & Severability): This document, together with our regional Privacy Policies, forms the complete understanding between Aegitox and you as the Guild Owner, superseding all prior discussions. If any single provision is found to be unenforceable by a court, we agree that it will be adjusted to the minimum extent necessary, ensuring the rest of our partnership agreement remains strong and effective.
Maintaining the Partnership: Because this agreement is built on trust with you specifically, you may not transfer or assign this enterprise license (such as through the sale of your server) without our prior written consent. We want to ensure any new leadership understands the tools they are inheriting.
Aegitox provides powerful B2B infrastructure, but your relationship is with us. We do not establish direct legal contracts with your individual community members or moderators. As the Guild Owner, your community looks to you for guidance, and you retain the sole authority, and the corresponding legal responsibility, for managing their experience, expectations, and any disputes that arise within your server.
2. Continuous Evolution & Platform Improvements
To stay ahead of evolving online toxicity and ensure we are always providing state-of-the-art moderation, Aegitox is a dynamic, constantly improving AI infrastructure.
Advancing the Technology: We are deeply committed to enhancing the Service. To do so, we must retain the flexibility to add, upgrade, refine, or (when necessary) deprecate specific features, algorithms, or API endpoints. While we strive to make every update a major improvement, we cannot guarantee that historical features will remain unchanged forever. Subscriptions support our ongoing R&D, and we generally do not issue refunds due to normal platform evolution.
Growing Together (Terms Updates): As our technology and global regulations evolve, we may occasionally update this Agreement to reflect new realities. Your continued use of Aegitox signifies your alignment with these forward-looking improvements. Any updates will only apply prospectively, ensuring fairness. If a future update doesn't align with your community's goals, you always retain the right to safely offboard your server.
3. The Discord Ecosystem & Experimental Innovation
Aegitox grants you a license to utilize our high-performance API. We are incredibly proud to operate within Discord, and our service is fundamentally designed to align with their ecosystem.
- Pioneering AI & "As-Is" Delivery: Generative AI moderation is an exciting, experimental frontier. While we deploy enterprise-grade bare-metal servers, we provide the Service "AS-IS" and without strict Service Level Agreements (SLAs). We rely on major upstream cloud providers, meaning occasional downtime or AI nuances are a shared reality of this cutting-edge technology.
- Language Capabilities (English Only): To ensure the absolute highest quality of AI moderation and keep our real-time pipelines running flawlessly, Aegitox Version 1 is exclusively engineered to support the English language. We do NOT currently support multilingualism. We want to be completely transparent: attempting to use the bot for non-English communities right now may lead to unpredictable AI behavior or missed violations. We are focusing on making English perfect first so you can focus on building a friendly, welcoming space!
- Respecting Discord's Core Policies: Our tools are built to help you maintain a healthy environment, completely in line with Discord's Terms of Service and Community Guidelines. Aegitox must never be used to circumvent Discord's native safety features or facilitate prohibited behavior.
- Protecting the Discord Platform Together: We view our relationship with Discord with the utmost respect. You agree to ensure your community utilizes Aegitox responsibly. If severe, coordinated abuse within your server causes Discord's Trust & Safety team to flag our application, impose global rate limits, or revoke our Privileged Intents, you acknowledge that you assume full responsibility for any resulting infrastructural or business damages to Aegitox. Let's work together to keep the platform safe for everyone.
4. Infrastructure Sustainability & Resource Fair Use
To keep Aegitox lightning-fast and cost-effective for thousands of communities, we rely on your commitment to fair use and system integrity.
Protecting AI Integrity: We ask that you prevent users from intentionally submitting malicious payloads, "jailbreak" prompts, or data poisoning attempts designed to break our AI safety guardrails. Attempting to exploit the foundational models undermines the safe environment we are all trying to build and is a breach of our shared trust.
Respecting the Architecture: Our native compiled libraries and AI logic are the heart of Aegitox. Reverse engineering, decompiling, or systematically scraping our API endpoints threatens the viability of the service for everyone and is strictly prohibited.
5. Exclusive Financial Partnership, Tax Truth & Billing Policies
To guarantee the absolute highest echelon of payment security, global tax compliance, and fraud prevention, Aegitox has entrusted its entire financial architecture to our deeply respected and exclusive partner, PayPro Global, Inc. PayPro Global acts as the authorized and exclusive Merchant of Record (MoR) for all Aegitox enterprise licenses. Your financial transaction is legally executed with PayPro Global, while your service usage remains governed by Aegitox under these Terms.
PCI-DSS Isolation: Aegitox explicitly does not process, transmit, or store your credit card data or payment instruments. All financial transactions are securely routed through and managed by PayPro Global's fortified infrastructure.
Tax Truth & Anti-Evasion Clause: You legally warrant and guarantee the 100% accuracy of your provided billing address and geographic location. Utilizing VPNs, proxies, IP spoofing, or false declarations to evade regional taxes (e.g., VAT, Sales Tax, GST) during the PayPro Global checkout process constitutes deliberate tax fraud and a material breach of this Agreement. You bear sole, absolute liability before all local tax authorities. You agree to fully indemnify and hold harmless both Aegitox and PayPro Global against any audits, penalties, or legal actions resulting from your falsified location data. Aegitox reserves the right to immediately terminate service without refund if tax evasion is detected.
Authorized Deduction & Subscription Management: By initiating a subscription, you grant PayPro Global the right to securely process your recurring payments. Subscriptions auto-renew seamlessly to prevent service interruption, unless canceled by you via the billing portal prior to the next billing date. If your server is removed from the platform due to an Acceptable Use violation, any unused subscription time is forfeit to cover administrative overhead.
6. Community Governance & Content Responsibility (DMCA & CDA 230)
Aegitox provides the technological conduit for your community, actively intercepting and transforming text using generative AI. We act as an impartial tool, while you retain full editorial control over the tone, rules, and outcomes in your server.
- Your Voice, Your Server (Communications Decency Act § 230): Aegitox operates under the protections of Section 230 of the CDA as an Interactive Computer Service. By enabling Aegitox to rewrite messages on your behalf, you adopt those AI-generated outputs as your server's curated speech. As the Guild Owner, you assume the role of the Publisher, ensuring the final output aligns with your community standards.
- Respecting Creators (DMCA Safe Harbor): We respect intellectual property. If our API inadvertently processes copyrighted material provided by your users, we claim DMCA Safe Harbor protection. Rights holders can reach our designated agent at dmca@aegitox.com. You agree to assist us in promptly addressing any valid takedown notices to keep the Discord ecosystem compliant and respectful of creators.
- Navigating AI Nuance & Shared Protections: Because Large Language Models are probabilistic, they may occasionally generate "hallucinations," quirky formatting, or imperfect rewrites. You acknowledge these technical realities and agree to hold Aegitox harmless from any disputes, defamation claims, or regulatory issues that arise from AI-generated text or automated moderation actions executed within your specific server environment.
7. Upholding Discord's Safety Standards for Minors
Protecting youth online is a foundational value we share with Discord. Aegitox is strictly designed as B2B moderation infrastructure and is absolutely not directed toward or intended for children. We stand shoulder-to-shoulder with Discord’s "teen-by-default" safety framework.
Partnering on Age Guidelines: We trust and rely on Discord's native age-gating mechanisms. By bringing Aegitox into your server, you confidently warrant that your community is not "child-directed" and that you actively support Discord’s minimum age requirements within your guild.
Our Commitment to Privacy & Swift Action: While we process text statelessly in volatile RAM, if we ever obtain actual knowledge that a server is improperly targeting children in violation of COPPA or GDPR-K, we will decisively sever the connection and purge the data to protect the ecosystem. As the Guild Owner, you assume the legal and financial responsibility to shield Aegitox from any regulatory inquiries stemming from your community's demographic management.
8. Customization & Transparency Responsibilities
Trust is paramount in digital communities. Aegitox embraces global transparency standards (including EU AI Act Art. 50, US FTC Section 5) by ensuring that users know when they are interacting with AI-modified content.
- The Default Badge of Trust: By default, text beautifully transformed by our AI is accompanied by a transparent badge (e.g., "✨ Upgraded by Aegitox AI"). This simple marker prevents confusion, honors user expectations, and guarantees baseline regulatory compliance for your server.
9. Protecting Our Craft & Intellectual Property
We have poured our passion and expertise into creating the Aegitox architecture, from the .NET assemblies and Angular frontend to our finely-tuned AI weighting mechanisms. This intellectual property remains exclusively ours, licensed to you to help your community thrive.
The Secret Sauce (System Prompts): The unique instructions, context windows, and guardrails we feed to the LLMs are our most highly guarded Trade Secrets. Attempting to deliberately extract these via prompt injection is harmful to our business and is treated as an actionable misappropriation of intellectual property.
10. Platform Integrity & Service Transitions
To maintain a premium, secure environment for all our partners and to uphold our commitments to the Discord ecosystem, we must manage network access responsibly.
Platform Security & Access: We hope to partner with your server for years to come. However, Aegitox retains the right to suspend or terminate access to the API at any time to preserve the health of the network or respond to ToS violations. While we aim to be transparent, such necessary security transitions do not entitle users to compensation or refunds for operational disruptions.
Some promises are foundational. To ensure mutual trust and protect against bad faith actions, the fundamental protections of this agreement—including our shared responsibilities regarding content liability, intellectual property, financial integrity with PayPro Global, and the structure of our liability shields—will naturally survive the end of your subscription or the departure of the bot from your server.
11. Dispute Resolution, Governing Law & Corporate Protections
We believe in resolving issues efficiently and fairly. To provide clarity and protection for both your community and our team, we agree to the following structured framework for handling disputes.
Governing Law (State of Delaware): Our partnership is governed by the laws of the State of Delaware, USA, providing a stable and highly respected legal foundation for our B2B agreement.
Predictable Liability Caps: To provide B2B software at scale, we must clearly define risk. Aegitox is not liable for indirect, incidental, or punitive damages. Our aggregate financial liability to you is capped at the total amount you paid to PayPro Global for the Service in the trailing twelve (12) months, or one hundred U.S. dollars ($100), whichever is greater.
12. Community Analytics & Data Principles
Providing Your Dashboard: To empower you with rich, real-time analytics on the Aegitox Dashboard (aegitox.com/dashboard), we process a minimized set of functional metrics. We securely cache basic display data (Usernames, limited to 256 characters for stability), Discord Identifiers, and fun behavioral inferences like Karma and Violation Counts.
Our Promise of Isolation (Row-Level Security): Your server's culture is its own isolated ecosystem. We enforce strict Row-Level Security (RLS) in our PostgreSQL database. Your members' Karma and behavioral stats are hermetically sealed within your Guild. We absolutely do not track users across different communities or aggregate global profiles. We are a moderation tool, not a data broker.
A Tool for Fun, Not Real-World Scoring: Aegitox Karma is an internal gamification feature designed to encourage positive chat vibes. It is absolutely not a consumer report under the Fair Credit Reporting Act (FCRA). You agree never to use Aegitox metrics to make real-world decisions concerning employment, credit, or legal status.
Workplace Environments: If you bring Aegitox into a corporate or employee Discord, you take the lead in ensuring your team is informed and that you comply with any local workplace privacy regulations.
13. Mutual Success & Indemnification
Because Aegitox acts as a tool executing your community's vision, you kindly agree to support, defend, and indemnify Aegitox and our trusted partners (like PayPro Global) from any external lawsuits, third-party claims, or regulatory actions that arise from how the bot is configured or used within your specific Discord server. We succeed by protecting each other.
14. Data Portability & EU Standards
In compliance with Chapter VI of the EU Data Act, B2B customers residing in the European Union maintain the statutory right to terminate this agreement and switch providers without undue vendor lock-in, subject to a maximum notice period of two months. Upon termination, we guarantee frictionless export capabilities for your custom AI prompt instructions and historical dashboard analytics.
15. Global Compliance & Trade Regulations
Aegitox proudly operates its core AI infrastructure within the United States. To maintain our standing with premier global banking partners and cloud providers, we strictly abide by U.S. Export Administration Regulations (EAR) and OFAC sanctions.
Honoring Embargoes: By using Aegitox, you warrant that you are not located in, or operating on behalf of, a comprehensively sanctioned region (including, but not limited to, Russia, Belarus, Cuba, Iran, North Korea, Syria, or the sanctioned regions of Ukraine). You also confirm you are not on any restricted parties list.
Protecting the Network: If we detect intentional sanctions evasion, we must instantly terminate the account to remain compliant with U.S. law. Due to the severe regulatory nature of these violations, refunds cannot be provided, and you agree to cover any resultant compliance auditing costs incurred by Aegitox.
16. Privacy Rights & Agreement Structure
We take data privacy very seriously and have built secure, frictionless pathways to help you and your users manage their digital footprints.
Controller vs. Processor Roles: Aegitox operates as your trusted Data Processor. As the Guild Owner, you are the Data Controller for your community. If your members wish to exercise their rights under GDPR or CCPA, they should reach out to you first, as you govern the server.
17. Data Deletion Exemptions & Global Security Architecture
We respect your fundamental right to data erasure and adhere to strict data minimization principles. However, to fulfill our existential security commitments to the community and remain in strict compliance with official Discord Developer Standards, specific retention exemptions apply to accounts that demonstrably violate platform integrity.[1] These security protocols are applied globally.
High-Risk Security Bans (IsBannedForSecurity)
Accounts involved in verified cyberattacks, malicious exploits, or severe platform abuse are flagged as critical security threats. We maintain the legally enforceable right to deny complete erasure requests for these entities. Retaining this limited cryptographic telemetry is strictly necessary to prevent fraud, protect against malicious activity, and ensure the ongoing security of our infrastructure.[2] This operational necessity is statutorily protected globally, including under the European Union's GDPR Article 17(3)(e) [3] and Recital 47 [4], as well as the United States' California Civil Code § 1798.105(d).[2]
Financial Disputes & Chargebacks (IsBannedForFinance)
Accounts that initiate hostile chargebacks or violate our financial terms are subject to permanent suspension. To balance your privacy rights with our operational integrity, we utilize a compliant cryptographic pseudonymization strategy when handling deletion requests for these accounts across all jurisdictions.
Global Erasure Policy for Financial Suspensions: Your user profile and identifiable data have been successfully deleted. A cryptographic hash of your account identifier (pseudonymized data) is securely stored on a suppression list solely to ensure compliance with our Terms of Service regarding previous financial disputes and chargebacks. Please note that separated financial transaction logs are preserved independently as mandated by overarching international, federal, and state tax, accounting, and anti-money laundering laws.
